<h2>Problemas en ventas a no contribuyentes?</h2><p>El artículo 460 del Código de Comercio reconoce expresamente que la factura, ya sea física o electrónica, constituye título ejecutivo contra el comprador, siempre que cuente con la firma de este o de su mandatario debidamente autorizado. En el caso de la factura electrónica, la norma exige que el documento digital tenga la firma digital del comprador y que, al momento de demandar, se aporte una copia impresa con el timbre fiscal correspondiente, acompañada además del respaldo digital de la factura original. De esta manera, el legislador le otorga a la factura electrónica la misma fuerza ejecutiva que tiene la factura física en los procesos de cobro judicial.</p><p>No obstante, el Código de Comercio no reconoce al tiquete electrónico como título ejecutivo. Este comprobante simplificado cumple una función eminentemente tributaria ante la Administración Tributaria, pero carece de la formalidad necesaria para presumir la aceptación de la obligación por parte del deudor, ya que no requiere su firma ni contiene los elementos exigidos para otorgarle valor probatorio ejecutivo.</p><p>A lo anterior se suma que, según criterios de la Dirección General de Tributación, en particular lo dispuesto en el oficio MH-DGT-DGCN-DGIC-OF-0847-2025, no es viable emitir facturas electrónicas a personas físicas o jurídicas que no son contribuyentes. En tales supuestos, la emisión de una factura electrónica resultaría en un documento nulo. Por ello, cuando la venta se realiza a un sujeto pasivo que no es contribuyente, la operación queda amparada únicamente en un tiquete electrónico, el cual, como se ha señalado, no tiene la condición de título ejecutivo.</p><p>Este cambio normativo entró en vigencia el 1 de septiembre, con la implementación de la versión 4.4 del sistema de facturación electrónica, que estableció que los no contribuyentes únicamente pueden recibir tiquetes electrónicos.
